Terms & Conditions

These Terms and Conditions ("Terms") form a binding agreement between Rare Infoway Private Limited ("we", "us", "our") and you, the user, for access to and use of the ZamZam mobile application (the "App").

By installing, registering for, or using the App, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy. If you do not agree, do not install or use the App.

These Terms operate within and are intended to complement:

• Data Protection Act, 2021 (Act 3 of 2021) — governing personal data processing (see our Privacy Policy).
• Electronic Communications and Transactions Act, 2021 (Act 4 of 2021) — including Part VIII consumer protections for electronic transactions.
• Competition and Consumer Protection Act, 2010 (Act 24 of 2010), as amended — including the mandate of the Competition and Consumer Protection Commission.
• Employment Code Act, 2019 and related labour laws — relevant to job listings and applications facilitated through the App.
• Cybersecurity and Cyber Crimes Act, 2021 — governing conduct on digital platforms.

Nothing in these Terms excludes or limits rights that cannot lawfully be excluded under Zambian law.

In accordance with the Electronic Communications and Transactions Act, 2021 (Part VIII obligations on suppliers):

• You must be at least 16 years old. If you are a child or vulnerable person under the Data Protection Act, 2021, a parent or guardian must consent under section 17 of that Act before you register.
• You must provide accurate, current, and complete registration information and keep it updated.
• You are responsible for safeguarding your credentials. Do not share your login. Report any suspected unauthorised access immediately to dhairy@rareinfoway.com.
• We may issue or revoke user roles (student, teacher, mentor, entrepreneur, employee, government, HR, administrator). You must not misrepresent your role to gain access to features you are not entitled to.
• You may not create duplicate or false accounts, impersonate any person or entity, or register on behalf of another person without their express authority.

ZamZam is a multi-role digital platform that currently provides, or may provide in future:

We may add, modify, or withdraw features with reasonable notice where practicable. The App is provided on an "as is" and "as available" basis.

6.1 Our Role

Unless we expressly state otherwise, we are an intermediary facilitating discovery, communication, and negotiation between buyers and sellers. We are not a party to any sale, exchange, or service agreement between users.

6.2 Seller Obligations

By posting a listing, you warrant that:

• You have the legal right to sell or transfer the item or service advertised.
• The listing content is accurate, lawful, and not misleading.
• The item or service complies with all applicable Zambian laws.
• You are not offering prohibited items (see clause 12 below).

6.3 Payments and Delivery

Unless the App integrates an in-app payment service (which we will notify you of separately), all payment and delivery arrangements are made directly between users, outside the App.

6.4 No Endorsement

We do not endorse, verify, or guarantee any listing, seller, buyer, product, or service on the marketplace.

7.1 Employer / HR Obligations

Employers posting jobs or internships warrant that listings are genuine, lawful, and comply with the Employment Code Act, 2019 and applicable Zambian labour and anti-discrimination laws.

7.2 Job Seeker Obligations

You warrant that information in your application (CV, skills, experience) is accurate. Providing false information may result in account suspension and may expose you to legal liability.

7.3 Platform Role

We facilitate discovery and application only. We are not party to any employment, internship, or contractor relationship formed through the App.

Mentorship sessions and communications conducted through the App are between the mentor and mentee. We facilitate the connection but do not supervise, validate, endorse, or guarantee the quality or accuracy of any guidance provided by mentors.

Teachers uploading course content warrant that it is original (or they hold the necessary rights), accurate, and lawful. Certificates issued through the App are generated based on completion of in-app activities. Their recognition by third-party institutions is not guaranteed or endorsed by us.

The AI guidance chatbot is powered by Google Gemini and is designed to provide general informational assistance. You acknowledge and agree that:

• AI responses may be inaccurate, incomplete, outdated, or unsuitable for your specific circumstances.
• The chatbot does not provide legal, financial, medical, employment, or professional advice.
• You should not make important decisions based solely on chatbot output without independent verification.
• We are not liable for any loss or harm arising from reliance on AI-generated content.

Where you are a consumer under the Electronic Communications and Transactions Act, 2021 and enter into an electronic transaction with us for paid goods or services, Part VIII of that Act may give you rights including prescribed information disclosures and, in certain circumstances, a cooling-off period.

The App is currently provided free of charge to end users. Consumer payment rules principally apply where you separately purchase premium features or services from us.

You must not:

• Violate any Zambian law or regulation, including the Cybersecurity and Cyber Crimes Act, 2021.
• Upload, share, or promote unlawful content — including defamatory, obscene content, or content that incites hatred or violence.
• List, advertise, or offer prohibited items: counterfeit goods; unlicensed weapons or ammunition; illegal drugs or controlled substances; stolen goods; content that sexually exploits minors; or fraudulent services.
• Harass, threaten, bully, or harm other users.
• Post false, misleading, or deceptive listings or applications.
• Misuse the AI chatbot to generate unlawful, harmful, or deceptive content.
• Impersonate any person, entity, or organisation.
• Attempt to gain unauthorised access to our systems or other users' accounts.
• Upload malware, viruses, or other malicious code.
• Scrape, crawl, or systematically extract data from the App without written permission.
• Circumvent age-verification, security, or access controls.
• Use the App to facilitate money laundering, fraud, or any financial crime.

We cooperate with Zambia Police, the Data Protection Commissioner, ZICTA, and other competent authorities as required by law.

13.1 Your Content

You retain ownership of content you create and upload ("Your Content"). By uploading or posting content, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, transmit, display, and where applicable index Your Content, solely for operating and improving the App.

13.2 Removal

On deletion of content or account (where available), we will cease active display subject to: residual backup cycles, legal retention obligations, or content forming part of another user's conversation or transaction history.

13.3 Our IP

Our software code, the ZamZam name and logo, design, documentation, and all original platform content remain the exclusive property of Rare Infoway Private Limited or our licensors. No licence to our intellectual property is granted to you except as expressly stated in these Terms.

13.4 Third-Party IP

Do not upload content that infringes the copyright, trademark, or other intellectual property rights of any third party.

The App integrates or relies on the following third-party services, each governed by their own terms and privacy policies:

We are not responsible for the availability, accuracy, or practices of these services. Disruptions to third-party services may affect App features.

Our collection and use of personal data is described in our Privacy Policy, aligned with the Data Protection Act, 2021. By using the App, you acknowledge having read the Privacy Policy.

To the fullest extent permitted by the laws of Zambia:

• The App is provided "as is" and "as available", without warranties of merchantability, fitness for a particular purpose, or non-infringement, except any implied warranties that cannot lawfully be excluded.
• We do not warrant that the App will be uninterrupted or error-free; video or audio calls will always connect; AI chatbot outputs will be accurate; marketplace listings are genuine; or job postings are real.
• We are not responsible for the actions, content, or conduct of any user or third-party service provider.

To the fullest extent permitted by Zambian law:

• We are not liable for any indirect, special, consequential, incidental, or punitive loss, or for loss of profits, data, goodwill, or reputation, arising from your use of the App or from disputes between users.
• Our total aggregate liability to you for all claims in any twelve-month period is limited to the greater of: (a) the total amount you paid us for the App or related services in that period; or (b) ZMW 0 if the App was provided to you free of charge.
• Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited under Zambian law.

You agree to indemnify and hold harmless Rare Infoway Private Limited, its directors, employees, and agents from and against any claims, losses, damages, liabilities, costs (including reasonable legal fees), and expenses arising from: Your Content; your breach of these Terms; your violation of any law or the rights of a third party; disputes between you and another user; or your misuse of the AI chatbot, marketplace, or any App feature.

• We may remove, edit, or suspend any listing, job post, message, or other content that breaches these Terms or applicable law, without notice.
• We may suspend or terminate your account (temporarily or permanently) for: material breach of these Terms; suspected fraud, harassment, or illegal activity; risk to other users; legal compliance; or discontinuance of the App.
• We will provide reasonable notice before termination where practicable and legally permissible, unless the breach requires immediate action.
• Provisions intended to survive termination (including clauses on liability, indemnity, intellectual property, and governing law) remain in effect.
• You may delete your account through the settings screens in the App. Deletion is subject to retention obligations described in our Privacy Policy.

We may amend these Terms by publishing the updated version at https://rareinfoway.com with a revised "Last updated" date. We will notify you of material changes through the App or by email. Continued use of the App after the stated effective date constitutes acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of the Republic of Zambia.
